TERMS OF USE
IMPORTANT: THESE TERMS CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS. PLEASE READ THEM CAREFULLY.
1) WHO WE ARE
These Terms are a legal agreement between you (“you”, “User”) and: ESSA STUDIO, MCHJ (“Company”, “we”, “us”, “our”). These Terms govern your use of our mobile application: “QR Code Reader, Barcode Scan” (also referred to as “CodeScanner” or the “App”), and any related websites, support pages, and services we provide (collectively, the “Services”).
2) ACCEPTANCE OF THESE TERMS
By downloading, installing, accessing, or using the App or Services, you agree to be bound by these Terms. If you do not agree, do not use the Services. If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.
3) ELIGIBILITY / AGE
The Services are not directed to children under 16 years of age. If you are under 16, you must not use the Services. If you are 16–17, you may use the Services only with the consent and supervision of a parent or legal guardian who agrees to these Terms.
4) CHANGES TO THE SERVICES AND TERMS
We may update the Services and these Terms from time to time (for example, to reflect new features, legal requirements, or security changes). If we make material changes, we will take reasonable steps to notify you (for example, via an in‑app notice). Your continued use after the effective date of updated Terms constitutes acceptance.
5) THE SERVICES (WHAT THE APP DOES)
The App provides tools that may include: (a) Scanning and decoding QR codes and barcodes. (b) Generating QR codes and barcodes. (c) Scan and generation history, and export features (where available). (d) Product information and price/offer discovery based on barcodes or images (including via third‑party services such as eBay, Sovrn, and Barcode Lookup). (e) Photo-based product search (where available). (f) Other utilities described in the App. NOTE: We do not manufacture, sell, or ship products shown in offers. We provide information and links to third parties.
6) SAFETY NOTICE FOR QR CODES AND LINKS
QR codes and barcodes can contain links or data that may be unsafe, misleading, or malicious. You are responsible for deciding whether to open links, submit information, or proceed with any action after a scan. We do not guarantee that scanned results are safe, accurate, or appropriate for your situation.
7) PRODUCT INFORMATION, PRICE COMPARISON, AND OFFERS
7.1 Product Data and Prices May Be Inaccurate
Product titles, images, descriptions, identifiers (UPC/EAN/GTIN), availability, and prices may come from third parties and may be incorrect, incomplete, delayed, or outdated. Prices and availability can change at any time and may vary by seller, region, shipping, taxes, and condition. You should verify details (including price, shipping, returns, and seller reputation) directly on the merchant’s site before purchasing.
7.2 Third‑Party Platforms and APIs
To provide product lookup and offer discovery, the App may use third‑party platforms and APIs, including (non‑exhaustive): eBay; Sovrn; Barcode Lookup. Your use of third‑party services may be subject to their terms and policies. We are not responsible for third‑party services, their content, or their availability.
7.3 No Endorsement
Mention of any third‑party brand, marketplace, or retailer does not mean we endorse them or that they endorse us. All trademarks belong to their respective owners.
8) AFFILIATE LINKS, DISCLOSURE, AND THIRD‑PARTY TRACKING
8.1 Affiliate Relationship (Commission Disclosure)
Some links shown in the App are “affiliate links.” This means we may receive a commission or other compensation if you click a link and make a purchase on a third‑party site. This does not necessarily increase the price you pay.
8.2 What Triggers Affiliate Tracking / Cookies
Affiliate tracking (including the placement of affiliate cookies or similar tracking technologies by third parties) occurs ONLY after you take an affirmative action, such as tapping a “Buy”, “View Offer”, “Shop”, or similar outbound link in the App. We do NOT trigger affiliate tracking merely because: • the App is installed, • the App is open in the background, or • you view scan results without clicking an outbound offer link.
8.3 Sovrn and Similar Providers
We may use third‑party affiliate technology providers (for example, Sovrn) to generate, redirect, and attribute affiliate links. When you tap an outbound offer link, certain technical data may be processed to enable link redirection and commission attribution (for example: IP address, device/browser information, timestamps, referral/source identifiers, and link identifiers).
9) FREE FEATURES, USAGE LIMITS, AND PAID FEATURES
9.1 Free Tier
We may offer limited free access. For example, free users may be limited to three (3) scans per day. Limits may be applied per device and may be enforced through technical measures.
9.2 Subscription‑Only Features
Certain features may be available only to subscribers, which may include (depending on plan): • Unlimited scans or higher daily limits • QR/Barcode generator • Scan and generation history • Export features • Additional premium features We may change which features are included in free vs. paid tiers from time to time.
10) SUBSCRIPTIONS, TRIALS, AND BILLING (APPLE / GOOGLE IN‑APP PURCHASES)
10.1 In‑App Purchases
If you purchase a subscription or lifetime access, payment will be charged through your Apple ID (App Store) or Google account (Google Play), as applicable, at confirmation of purchase.
10.2 Auto‑Renewing Subscriptions
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price shown to you at purchase (unless a price change is communicated and your consent is required).
10.3 Free Trials
If a subscription includes a free trial, you will not be charged until the end of the trial period. If you do not cancel before the trial ends, the subscription will renew automatically and you will be charged.
10.4 How to Cancel
You can manage or cancel your subscription in your App Store / Google Play account settings. We do not control subscription billing and cannot cancel subscriptions on your behalf.
10.5 Refunds
Payments and refunds are handled by the relevant app store and are subject to their policies. If you believe you were charged in error, please use the store’s refund/charge dispute process.
10.6 Lifetime Access
If you purchase a “lifetime” plan, it grants access for the lifetime of the App/Service as offered by the Company (not the lifetime of the User), and is subject to these Terms, store policies, and applicable law. We may still discontinue or change parts of the Services as described in these Terms.
10.7 Usage Information for Refund Reviews (Apple / Google)
By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple&s policies and only as necessary to process your requests.
11) USER CONTENT, HISTORY, AND EXPORTS
11.1 Your Content
“User Content” includes information you enter into the App (for example, text used to generate a QR code), saved scan history, and files you export.
11.2 Ownership and License
You retain ownership of your User Content. You grant us a limited, non‑exclusive, worldwide, royalty‑free license to use User Content only as necessary to operate the Services (for example, to generate a code, show history on your device, or enable export you request).
11.3 Responsibility
You are responsible for your User Content and for how you share/export it. Do not export or share content that you do not have rights to share, or that violates any laws or third‑party rights.
12) PROHIBITED USE
You agree not to: • use the Services for unlawful, fraudulent, or harmful purposes; • generate or distribute malicious QR codes, spam, phishing links, or deceptive content; • attempt to reverse engineer, decompile, or bypass security of the App; • interfere with the operation of the Services (including generating automated, non‑human clicks or traffic); • use the Services in a way that violates any third‑party terms (including marketplace/affiliate program rules).
13) INTELLECTUAL PROPERTY
The App, Services, and all associated software, design, logos, and content (excluding third‑party content and User Content) are owned by the Company or its licensors and are protected by intellectual property laws. You receive a personal, limited, non‑exclusive, non‑transferable, revocable license to use the App for its intended purpose, subject to these Terms.
14) THIRD‑PARTY CONTENT, LINKS, AND SERVICES
The Services may display or link to third‑party content (including product listings, images, prices, and merchant pages). We do not control third parties and are not responsible for third‑party content, products, services, or practices. Your dealings with third parties are between you and the third party.
15) SERVICE AVAILABILITY; MAINTENANCE; INTERRUPTIONS
We aim to keep the Services available, but we do not guarantee uninterrupted operation. The Services may be unavailable, delayed, or limited from time to time due to scheduled maintenance, updates, emergency repairs, network or equipment failures, outages of third-party providers, or events outside our reasonable control. We may modify, suspend, or discontinue any part of the Services at any time (for example, to improve features, ensure security, comply with legal requirements, or address operational issues). We may also change which devices, operating systems, or versions are supported. Where required by applicable law, we will provide reasonable notice of material changes or discontinuation.
16) DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR‑FREE, SECURE, OR UNINTERRUPTED, OR THAT SCAN RESULTS OR PRODUCT/OFFER INFORMATION WILL BE ACCURATE OR COMPLETE.
17) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW: IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $10 (OR EQUIVALENT). Some jurisdictions do not allow certain limitations. In such cases, these limitations apply to the fullest extent permitted by applicable law.
18) INDEMNIFICATION
You agree to indemnify and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Services, (b) your User Content, or (c) your violation of these Terms or applicable law.
19) TERMINATION
We may suspend or terminate your access to the Services if you violate these Terms or if required for security, legal, or operational reasons. You may stop using the Services at any time by uninstalling the App. Sections that by their nature should survive termination will survive (including IP, disclaimers, limitation of liability, and indemnification).
20) GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of Uzbekistan, excluding conflict of laws rules. Courts located in Tashkent, Uzbekistan shall have jurisdiction, except where mandatory consumer protection laws provide otherwise. If you are a consumer, nothing in these Terms limits your statutory rights under applicable consumer laws.
